The Perm plant lost the dispute to the state about the patent for the howitzer “Koalitsiya-SV”

The Presidium of the Intellectual Property Rights Court considered the cassation appeal of the Motovilikhinskiye Zavody PJSC in Perm regarding a dispute with the Prosecutor’s Office of the Nizhny Novgorod Region and the Ministry of Defense of the Russian Federation regarding a patent for the Koalitsiya-SV self-propelled artillery mount. This is stated in materials cases published in the arbitration file.

The supervisory agency went to court in November 2022, demanding that the Russian Federation be the sole patent holder of the howitzer. The authorship of the industrial design belonged to engineers and designers of weapons, and the patent was received by Motovilikhinskiye Zavody and the Nizhny Novgorod Central Research Institute Burevestnik, which carried out R&D under a contract with the Ministry of Defense in 2006.

Although Motovilikhinskiye Zavody was not the lead executor of the project, they received exclusive rights to the result of intellectual activity for an industrial design. In turn, the Central Research Institute “Burevestnik” did not issue a patent within the established six-month period. The prosecutor’s office proved that the customer has the right to a patent and an invention under a state contract, so the Russian Federation is the only copyright holder. The company failed to appeal this decision.

Self-propelled 152-mm howitzer “Coalition-SV” is designed to destroy artillery and mortar batteries, tanks and air defense systems. The howitzer allows you to remotely control firing, select targets and use navigation.
